Terms and Conditions of Online Credit/Debit Card Customers

1Definitions
In these terms and conditions the following definitions shall, except where the context otherwise requires, have the following meanings:
  • “Customer” means the company, person or firm which has agreed to purchase Services from STRUS in accordance with these terms and conditions, the Site terms and conditions and the Site privacy statement,
  • “Services” means the provision of any reports, data, information and other services,
  • “STRUS” means Severn Trent Retail and Utility Services Limited,
  • “Site” the website by which the Customer accessed the Services.

2Status of Terms and Variations
2.1.These terms and conditions are supplemental to the standard terms and conditions upon which the supply of the Services is carried out.
2.2.The payment for the supply of the Services to the Customer shall be subject to these terms and conditions which shall supersede any other conditions in any document or other communication used or issued by the Customer in relation to any Services.
2.3.No variation to these terms and conditions is effective unless and until STRUS expressly agrees in writing.

3Charging Procedure and Payment
3.1Where the Customer chooses to make payment for the Services by credit/debit card, the Customer shall enter its correct credit/debit card details where requested on the Site [and will “accept” the terms and conditions.] The Customers credit/debit card will thereafter be charged for the full cost of the Services and the Customer’s credit/debit card shall be subsequently debited the full cost of the Services ,except in the circumstances cited in Clause 3.3
3.2An order for Services will not be cancelled for charging purposes once the request has been recorded on STRUS systems or processing has otherwise commenced.
3.3If the Customer attempts to purchase a report or any other part of the Services where the price is not stated on the STRUS website or is listed as "zero pounds price on application" on the STRUS website STRUS shall contact the Customer to confirm the actual price following which the Customer shall decide whether they wish to proceed with the transaction and notify STRUS accordingly. Once the price is communicated and agreed by the Customer STRUS' s acceptance of the Customer’s order will bring into existence a legally binding contract.
3.4STRUS shall not fulfil any orders until full payment has been received from the Customer. Products that are priced at zero pounds at the point of ordering will need to be charged as an additional payment, with the customers’ permission.
3.5STRUS will issue a VAT receipt to the Customer, upon request.. If you do not receive this or have any enquiries please contact enquiries@severntrentsearches.com
3.6If the Customer would like to cancel an order it should contact enquiries@severntrentsearches.com or telephone 0115 971 3550. Refunds can only be given to any Service or any part thereof which has not been recorded on STRUS systems or processing has otherwise commenced.

4Changing or closing online access
4.1The customer does not have a facility STRUS may withdraw the online facility in any event by 48 hours prior notice to the Customer.

5Notices
5.1Notices to be given by the Customer to STRUS in accordance with these terms and conditions should be made in writing to:

or other such address as may be notified to the Customer by STRUS from time to time in accordance with Clause 5
5.3Notices to be given by STRUS to the Customer in accordance with these terms and conditions should be made in writing to the address notified by the Customer to STRUS when applying or other such address notified by the Customer to STRUS in accordance with this Clause 5.
5.4A notice sent by first class post in accordance with this clause is deemed to have been received 48 hours after posting.

6Variation of Terms
6.1STRUS has the right to change any of these terms and conditions on giving not less than 14 days notice to the Customer

7Law and Jurisdiction
7.1These terms and conditions are subject to English Law and the exclusive jurisdiction of the English Courts
